Privacy Policy

Wave Law® PLLC (“Wave Law”) operates the wave.law website (the “Website”).  It is Wave Law®’s policy to respect your privacy regarding any information we may collect while operating the Website.

This Privacy Policy is intended to be consistent with (and supplement) our obligations under applicable laws, including the European Union (“EU”) General Data Protection Regulation ("GDPR"). 

1.     Website Visitors

Wave Law®’s web hosting service  and/or its hosting service provider (together, “Web Provider”), collects non-personally-identifying information of the sort that web browsers and servers typically make available for website visits, such as the IP address, time, date, location, referring site and detailed browser information. Wave Law®’s purpose in collecting non-personally identifying information is to better understand how Wave Law®’s visitors use the Website. From time to time, Wave Law® may release non-personally-identifying information in the aggregate to third parties, including service providers to us, such as our Website developer.

2.     Collecting Personally-Identifying Information

Certain visitors to the Website choose to interact with Wave Law® in a manner that gathers personally-identifying information. The amount and type of information that Wave Law® gathers depends on the nature of the interaction. For example, visitors may contact us through the firm’s general contact email at contact@wave.law, by phone, or through individual attorney email addresses. Any information you provide through these means may be used internally by Wave Law® to perform a conflict of interest check, which is done to prevent communication with or representation of opposing parties in the same or similar matter. In each case, Wave Law® collects such information only  if necessary or appropriate to fulfill the purpose of the visitor’s interaction with Wave Law®. Wave Law® does not disclose personally-identifying information other than as described below. Visitors are free to refuse to supply personally-identifying information, with the qualifier that it may prevent them from engaging in certain website-related activities.

3.     Aggregated Statistics

Wave Law® may collect statistics about the behavior of visitors to the Website. Wave Law® may provide this information to others. However, Wave Law® does not disclose personally-identifying information other than as described below.

4.     Protection of Certain Personally-Identifying Information

Wave Law® discloses potentially personally-identifying and personally-identifying information only to those of its attorneys, contractors and affiliated firms that (i) need to know that information in order to process it on Wave Law®’s behalf, and (ii) that have agreed not to disclose it to others, and only in accordance with applicable laws, regulations, and professional responsibility and ethics rules (the "Bar Rules"). Some of those attorneys, contractors and affiliated firms may be located outside of your home country. By using the Website, you consent to the transfer of such information to them. Wave Law® will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its attorneys, contractors and affiliated firms, as described above, Wave Law® discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Wave Law® believes in good faith that disclosure is reasonably necessary to protect the property or rights of Wave Law®, third parties or the public at large, and only in accordance with Bar Rules. If you contacted us through the Website and have supplied your email address, Wave Law® may occasionally send you an email to tell you about new content (such as a blog entry about new legal developments, or a recent deal we may have worked on), solicit your feedback, or just keep you up to date with what’s going on with Wave Law® and our services. Wave Law® takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

5.     Cookies

Cookies are small text files a web domain (or website) can use to recognize repeat users, facilitate the user’s ongoing access to and use of the site and allow a site to track usage behavior and compile aggregate data. Cookies can improve a visitor’s browsing experience because they help websites remember preferences and understand how people use different features. Wave Law®’s Web Provider places cookies on the browsers of visitors to the Website to help the Website run effectively, provide the best experience for our visitors, and help Wave Law® learn more about traffic to the Website. Wave Law® visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Website, with the drawback that certain features of the Website may not function properly without the aid of cookies.

6.     NON-U.S. LAW

In our activities outside the United States and/or involving persons located outside the United States, we comply with the privacy laws applicable to those activities, which may impose obligations in addition to those of United States law.

For activities in the EU or involving EU residents, we comply with GDPR, including by obtaining consent for processing of personal information. In the event that Wave Law® may need to transfer your personal information to an affiliated firm in a foreign jurisdiction that does not provide a similar level of protection for that data, Wave Law® will ensure that safeguards are applied on your data, such as the use of specific contracts approved by the European Commission. 

7.     California Privacy Rights

If you are a Consumer receiving products or services for which we are a Business, as those terms and any other capitalized terms here are defined under the California Consumer Privacy Act of 2018 (California Civil Code §§ 1798.100 to 1798.199) and the related regulations, as amended (the “CCPA”), California law permits you to request information regarding the:

·       Categories of Personal Information (as defined by applicable California law) Collected, Sold or Disclosed by us;

·       Purposes for which categories of Personal Information Collected by us are used;

·       Sources of information from which we Collect Personal Information; and

·       Specific pieces of Personal Information we have Collected about you.

We do not offer financial incentives to Consumers based upon the retention or sale of a Consumer’s Personal Information. 

As of the date of this Privacy Policy, Wave Law® has no reason to believe that we have collected, disclosed, sold or otherwise processed the Personal Information of more than 4 million California Consumers. 

You may make requests related to your California privacy rights by calling 202-964-1050 or by email to contact@wave.law or in writing to Wave Law® PLLC, 1900 Reston Metro Plaza, Reston, VA 20190. Please be aware that we do not accept or process requests through other means (e.g., via fax or social media).

We will review the information provided and may request additional information to ensure we are interacting with the correct individual. This additional information may vary depending on the nature of your request and/or the nature of the information about which your request relates. In some cases, we may also be required by law to obtain a signed declaration under penalty of perjury from you that you are the subject of the request being made. If we suspect fraudulent or malicious activity, we will delay taking action on your request until we can appropriately verify your identity and the request as authentic.

By law, we are not required to collect Personal Information that we otherwise would not collect in the ordinary course of our business, retain Personal Information for longer than we would otherwise retain such information in the ordinary course of our business, or reidentify or otherwise link information that is not maintained in a manner that would be considered Personal Information. If we have not requested specific additional information from you to verify your request, please do not send such information. 

We generally will aim to avoid requesting additional information from you for the purposes of verification. However, if we cannot reasonably verify your identity or more information is needed for security or fraud-prevention purposes, we may consider any of the following factors, alone or in combination, in requesting additional information:

·      The type, sensitivity, and value of the personal information collected and maintained about the Consumer, as applicable law requires a more stringent verification process for sensitive or valuable Personal Information;

·       The risk of harm to the Consumer posed by any unauthorized access or deletion;

·       The likelihood that fraudulent or malicious actors would seek the Personal Information;

·       Whether the Personal Information to be provided by the Consumer to verify their identity is sufficiently robust to protect against fraudulent requests or being spoofed or fabricated;

·       The manner in which the business interacts with the Consumer;

·       Available technology for verification; and

Other factors that may be reasonable in the circumstances, are consistent with industry practice, are recommended by California government officials, or which may be required by law or regulation following the effective date of this Privacy Policy.In some cases, we may not have sufficient information about you to be able to verify your identity or sufficiently differentiate you from another Consumer to the degree of certainty required by law, in which case, we will not be able to act upon your request. In such cases, it may be unlikely that we would be able to identify you in the future without collecting significantly more information or seeking to reidentify deidentified information. At this time, we do not intend to take such steps in response to a request made pursuant to this Privacy Policy and applicable law does not require that we do so. If, in the future, we determine a reasonable method to identify you household without such steps, we will provide an update to you through this Privacy Policy and in response to any such request at that time.

Information that you submit for the purpose of allowing us to verify your identity in furtherance of a Consumer-related request pursuant to California law will only be used by us, and our service providers if any, for that purpose and no other. Except where we are required by law to maintain such information for record-keeping purposes, we will take steps to delete any new Personal Information collected for the purpose of verification as soon as practical after processing your request.

Please also be aware that making any such request does not ensure complete or comprehensive removal or deletion of Personal Information or content you may have posted, and there may be circumstances in which the law does not require or allow us to fulfill your request, including, for example, where fulfilling your request may infringe upon the rights and freedoms of other Consumers.

We reserve the right to charge a reasonable fee or take other appropriate action in response to requests from a Consumer that are manifestly unfounded or excessive, in particular because of their repetitive character.

You may designate an authorized agent to make a request on your behalf pursuant to applicable law. We accept documentation of your designation in the form of a valid power of attorney and/or a notarized statement. You must submit evidence of your designation of an authorized agent in writing to: Wave Law PLLC, 1900 Reston Metro Plaza, Reston, VA 20190. We may require verification of your authorized agent in addition to the information for verification above for Consumers. 

8.     Business Transfers

If Wave Law merges with or is acquired by another law firm, or in the unlikely event that Wave Law® goes out of business, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any firm that merges with or acquires Wave Law® may continue to use your personal information as set forth in this Privacy Policy. 

9.     Privacy Policy Changes

Wave Law® may change its Privacy Policy from time to time, and in Wave Law®’s sole discretion. Wave Law® encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this Website after any change in this Privacy Policy will constitute your acceptance of such change.
